What to Check Before Buying Land on Maui
Land is where the details really matter. Two parcels that look alike online can be completely different once you get into the paperwork. None of this is legal or engineering advice, and zoning and permit rules change, so every item below should be confirmed with the County of Maui, a surveyor, a title company or an attorney as it applies to that specific lot.
Zoning and Permitted Uses
County zoning and the state land use district decide what can go on a lot and how it can be used. Agricultural land has its own rules for dwellings and farm use. Never assume a second home, a rental or a subdivision is allowed until it's confirmed.
Water
Water is the first question on almost every Maui parcel. Some lots have a county water meter, some have a meter reserved, some rely on catchment or a private system, and some have nothing yet. It affects what you can build and what the land is worth.
Utilities and Access
Check for power, phone and internet at the lot line, how far the nearest connection is, and whether access is by a county road, a private road or an easement across a neighbor. Road maintenance agreements matter too.
Topography and Setbacks
Steep slopes, gulches and drainage can shrink the usable building area and add real cost. Setbacks from property lines, streams and the shoreline also limit where the house can go.
CPR Status
Many Maui lots are held as a CPR, a condominium property regime where two or more owners share one parcel. Read the declaration and bylaws, understand what's common area versus your limited common element, and find out how decisions get made.
Coastal and SMA Issues
Parcels near the ocean may fall inside the Special Management Area or shoreline setback, which can add a separate permit process. Erosion history and flood zone maps are worth reviewing early.
Survey, Title and Easements
A current survey confirms the boundaries and shows any encroachments. The preliminary title report lists easements, restrictions and anything recorded against the land. Read both before your contingencies run out.
Taxes and Carrying Costs
Maui County property tax rates depend on the classification of the land, and agricultural dedication can change the bill. Ask for the current tax figures on any parcel and budget for insurance, clearing and upkeep while you plan your build.
